The archives of the Conseil d'État relating to the period of the Consulate and the First Empire were destroyed in 1871 in the fire at the Palais d'Orsay which housed the Conseil at the time. The bulk of manuscript sources are in the Archives Nationales, in the collection of the Secrétairie d'État Consulaire et Impériale AF IV. Other documents can be found in series BB1 (Ministère de la Justice) and F1a (Ministère de l'Intérieur).

  Retrospective publication of the minutes of all the sessions of the Conseil d'État concerned with the drafting of the Code of civil law (first 16 volumes), the Code of mercantile law, the Code of criminal procedure, the Code of criminal law and the Code of civil procedure. Whilst the discussions are summarised and their tone has been standardised, this collection is however of paramount importance.

Correspondence of Napoleon I

There are numerous letters in the Correspondence of Napoleon concerning the Conseil d'État or its members. No collection yet exists containing the whole of this correspondence. A good deal was published in the Second Empire: further books have been published regularly since (see TULARD (Jean), "La correspondance de Napoléon", in Journal des Savants, January 1966, p. 48-56).

  Volume III describes the running of the Conseil d'État up until the end of An X, as seen by one of its leading conseillers. Volume VII includes reports and speeches connected with the activity of Roederer as a conseiller d'État.

  Published without the name of the author, who was in exile at the time, this book relates to the period when Thibeaudeau was sitting on the Conseil d'État (early An IX-Floréal to An XI) and much of it relates the activity of this body. Rather imprecise chronology.

  Volume I contains about fifty pages on the Conseil d'État of which Pasquier was a member from 1806 on.
  
  
• MIOT DE MELITO (André-François), Mémoires, Paris, 1858, 3 vol.
  Miot was a conseiller three times: for several months in An IX; from 1803 to 1806; and finally during the Cent-Jours. His memoires mention certain debates in the Conseil d'État, such as those following upon the assassination attempt on the rue Saint-Nicaise.

• PELET DE LA LOZERE (Privat Joseph Claramond), Opinions de Napoléon sur divers sujets de politique et d’administration… et récit de quelques événement de l’époque, Paris, 1833.
  This account relates to the period from December 1803 to the middle of 1807. The author, who entered the Conseil as an auditeur in 1806, declares that he has used for the previous period "notes collected from a trustworthy source", which may be that of his father, Jean Pelet, conseiller d'Etat from An X on. These opinions of Napoleon only concerned the Conseil d'État in its role in judicial matters. Handwritten notes for a second edition and several unpublished recollections are held in the Bibliothèque Thiers, Papiers F. Masson, Carton 272.
